    What is a Trademark?
    A “trademark” is a word, phrase, symbol, color, design, or a combination thereof, that identifies and distinguishes the source of the goods of one party from those of others. A service mark is the same as a trademark, except that it identifies and distinguishes the source of a service rather than goods.
    Why is a trademark important?
    A Trademark provides exclusive right to use a mark that serves to distinguish the goods of one person from another. The trademark may increase in value as the products or services with increased brand recognition and consumer recognition and loyalty. Trademark = Asset ($$)
    How long is the process?
    Depends. You should receive an initial response from the US Patent and Trademark Office (USPTO) within approximately 3 months of filing the application. However, the total application processing time may be anywhere from 6 months to a year, or even longer, depending on the results of the initial response.
    Why should I even get a trademark?
    Money, Money, and More Money: If you have infringed on someone else's name or mark, you may be ordered to rename your company immediately; give up all profits earned by the use of the unregistered mark; and pay other damages, including punitive damages, fines, and attorneys' fees. YOUR TRADEMARK PROTECTS YOU FROM THESE PITFALLS!
    Do I need to hire an Attorney for this?
    Applications filed by attorneys are 50% more likely to be successful than those filed by non-attorneys. 83% of all trademark applications receive an initial rejection. If you don't know how to respond, it could cost you time, money, or your trademark!
    Do I need to renew my Trademark?
    Yes. Separately from the requirement to declare continued use of your trademark (5th-6th year mark), you must renew the registration every 10 years.

    I did not hire a trademark attorney and I received an office action. What do I do?
    Don’t Panic. It’s not too late. If you received notification from the USPTO rejecting your mark WE CAN HELP. In many cases, those rejections can be overcome with strategic and tactical legal arguments that blow the Examiner’s opinion out of the water! Be careful, however, if you decide to respond on your own because some actions the Examiner recommends can weaken your mark or cause additional rejections!!
    What is one of the biggest mistakes relating to trademarks?
    WAITING. The US is a First To File Country. Countless times potential clients call and discuss filing a trademark "after" they have spent months/years and hundreds/thousands of dollars creating, building, and promoting their business only to realize someone else "snuck in" before they did and filed their exact trademark at the USPTO. When this happens, this becomes a "Worst Case" nightmare since there are legal consequences (see answer to question above) and your brand power may be diluted, unprotected, and experience a LOSS OF ECONOMIC VALUE!
    How does obtaining a trademark benefit me and/or my business?
    Simply stated, a federally registered Trademark protects your brand, business, logo, website domain, and/or all the hard work you have created. Your trademark prevents someone from stealing and infringing your mark without risk of severe legal consequences. 

    A trademark gives credibility and enhanced economic value to your business.
